ImmuDyne’s Motion in Biothera Patent Infringement Lawsuit Denied
EAGAN, MN – May 29, 2008 – A Minnesota Federal District Court has rejected ImmuDyne Inc.’s motion to dismiss Biothera’s request for a permanent injunction. Biothera is suing ImmuDyne for patent infringement.
The lawsuit alleges that ImmuDyne has violated U.S. Patent Nos. 4,992,540, 5,037,972, 4,962,094 and 6,020,3424, which provide Biothera with ownership and exclusive rights to manufacture and sell yeast-derived immune health dietary supplements and ingredients.
Biothera is satisfied with the court’s decision and remains confident in a successful outcome.
